Allen v GMB resolved The court of appeal has resolved the long-running feud of Allen v GMB, it has been reported.
According to Personnel Today, it was recently ruled that the claimants had been discriminated against through the methods the GMB had used to secure a fair single-status pay deal, even if the objective of securing the deal was legitimate in its own right.
It was argued by judges that the tactics used to persuade the claimants to accept the settlement were unacceptable, even though it was trying to balance the conflicting interests of all of its members.
The original case arose out of a dispute with workers at Middlesbrough borough council, which was prioritising pay protection for male members of its team over favourable back pay for their female counterparts.
In July, the court of appeal ruled in favour of the GMB, citing the case's unique circumstances and objective justification in its pursuits, meaning that the 26 female claimants had not been discriminated against or victimised.
