Allen v GMB verdict announced
Judgment from the court of appeal has been handed down on the "important yet controversial" case of Allen & Ors v GMB, it has been reported.

An employment law bulletin released by barrister Daniel Barnett explains that the decision restores the original 2006 ruling which held the GMB responsible for indirectly discriminating against union members at Middlesbrough council while negotiating with their employer.

The newsletter said that the union had recommended the acceptance of a pay deal for single status which many thought to "grossly underestimate" the compensation due to female equal pay claimants.

It continued that the objective was legitimate in its goal and led to the reversal of the decision on 31st July 2007 when the court of appeal found in favour of the union.

However, Daniel Barnett explains that the actions directed at female back-pay claimants led the court to turn around the verdict once more, with permission to appeal to the House of Lords refused.

James Baker, an employment expert at Macfarlanes, told the Times that people "can expect similar pay deals to come under the judicial microscope as a result" of the judgement.
